Alabama Nissan Dealership Sales Car With 2 Titles but Refuses to Take It Back
One Alabama man is stuck with a car due to mistakes made by a Nissan dealership. The vehicle was sold with two titles from different states. Now the dealer is being sued for fraud as multiple locations refuse to accept the sedan as a trade-in.

Owning a 2019 Nissan Altima has been a headache for Zachary Hopkins of Alabama. He’s suing a dealership for fraud after it sold him the car with two titles from different states and inconsistent odometer readings.
He purchased the sedan from Serra Nissan as-is for $25,180. The odometer disclosure form and title application gave the figure as the actual mileage.
According to Automotive News, while signing the paperwork for the deal, the salesperson only showed him the first page of the Carfax report. But the full report indicates Alabama and Indiana issued titles for the Altima and had a “not actual mileage” brand.
He visited a different Serra dealership to trade the car in, but was denied due to the branded title. Serra Nissan also refused to accept the vehicle as a trade.
A judge approves Hopkins’ request to sue over fraud after the first trial had allegations of fraud and misrepresentation, breach of fiduciary duty. Claims for negligent hiring, training, and supervision were dropped.
A jury found that there was no evidence that any employee was incompetent and that the dealership was aware of such a problem. Apparently, Hopkins fails to explain how Serra should have been aware of their actions.
Perhaps this should serve as a reminder to fully read CarFax reports before purchasing used cars. Check the paperwork and odometer readings.
