You can’t mess with Buc-ee’s right now. This gas station has been exploding with popularity, making it a little too big for its britches. It’s going after a Texas gas station for alleged trademark infringement. 

Buc-ee’s sues Texas gas station for trademark infringement 

Buc-ee’s logo involves a Beaver wearing a red hat on a yellow background that’s shaped like a circle. It’s hard to miss as it adorns billboards for various locations across the nation. 

However, Buc-ee’s isn’t letting competitors get anywhere near its happy beaver. That’s why Dallas-based Super Fuels is getting sued. 

Reportedly, the gas station has a circular logo with a smiling brown dog, wearing a red cape, on a blue background. 

According to Chron, Buc-ee’s feel as if the dog mimics the beaver. I mean both animals are brown and they both have red clothing on. However, blue is different from yellow. 

Buc-ee’s claims that most people who see the infringing marks are drivers incapable of providing anything beyond a briefglance at the infringing marks. Passengers also have little time to see the logo.

The lawsuit claims that the Super Fuels’ use of the infringing marks is likely to cause confusion among consumers in the relevant market. It may cause deception and affiliation and. or origin of Buc-ee’s goods and services. 

Super Fuels has two locations in Dallas and one in Irving. Buc-ee’s locations are popular in Dallas, Fort Worth, Denton, Terrell, and Hillsboro. 

The lawsuit claims that the similarity between the logos hindered its participation in interstate commerce. However, with Buc-ee’s growth and popularity, one could argue that the stores are doing just fine. 

Along with attempting to force Super Fuels to stop using the design, Buc-ee’s is seeking damages, defendant profits attributed to the infringement, and attorney’s fees.
