California Motorcyclist Hit at ‘Walking Speed’ Wins $14 Million
Even wrecks that occur at low speeds can be extremely dangerous. This is one thing that a motorcyclist from California knows all too well. He was struck by a car traveling at a low rate of speed and has suffered from neck and groin injuries ever since.
Jury awards California motorcyclist $14 million over low-speed accident
It was a beautiful day in California, as Iain McDonald took his motorcycle out for a spin. However, the ride was cut short as Areg Zaragaryan hit him with his car.
According to Case Law, the collision occurred at “walking speed” and didn’t seem to have a severe impact at the time. Police officers came to document the collision, but there wasn’t a need for emergency services.
The motorcyclists didn’t fall to the ground and walked to the sidewalk without assistance. He later went to a clinic for pain in his hip, leg, and foot. But not his neck or groin.
This is important because he later claimed the collision left him with debilitating injuries to his neck and groin. Despite continuing to go rollerblading and snowboarding after the incident, a jury awarded him $13,872,000.
The expenses are broken down into $1,872,900 for future medical expenses, $2 million for past pain/suffering, and $10 million for future pain and suffering.
Zargaryan and his lawyers appealed the verdict. No one mentioned anything about spinal pain, surgery, or a related medical problem until six years after the collision.
Doctor Toorag Gravori was added to the case as a witness a month after expert designations by the plaintiffs were exchanged. Gravori has a professional relationship with McDonald’s trial lawyer.
They claim Gravori was late to testify and shouldn’t have been allowed. He may have prompted the jury to award more than they otherwise would have.
