A Massachusetts Toyota dealership is in hot water. A man named Eric Aborjaily was picking up his truck when he received instructions to walk through a roller service bay door. The door suddenly slammed shut and struck him in the head, causing severe brain injuries.
Reportedly, the lawsuit names the Toyota dealership and Rytec, the manufacturer of the door, as defendants. Allegedly, there were no signs or warnings to alert customers to stay away from the service area. Also, Aborjaily was invited in.
The lawsuit claims that the Toyota dealership violated its duty to care for customer safety. Plus, the roller door was improperly designed, manufactured, installed, or maintained. Both entities are being accused of negligence and breach of warranty.
According to Auto News, Aborjaily suffered lasting brain, head, and dental injuries. Allegedly, at the time of the incidents, the safety systems were not operating appropriately or had failed.
Typically, customers aren’t allowed in auto service bays for safety reasons. These cars could be surrounded by moving equipment, hot fluids, sparks, chemicals, tools, and fast-moving vehicles.
Plus, emergency situations and customer interference via coming in to ask about updates can be distracting. It slows the repair processes down. It’s also an Occupational Safety and Health Administration (OSHA) violation to allow customers in service areas.
