1 legal way to get out of speeding tickets gives police officers headaches
First of all, speeding is deadly. Slow down out there. Second of all, don’t use me as a source for legal advice, I’m simply a humble auto journalist. However, police officers in North Carolina have been frustrated by this legal way for drivers to get out of speeding tickets.
1 legal way to get out of speeding tickets that police officers want to stop
According to the Charlotte Observer, drivers have been using a legal loophole to get out of speeding tickets. Police officers all over the country want to end this to stop speeders from avoiding consequences.
The loophole is known as the improper-equipment plea. It allows drivers to avoid all license and insurance penalties by claiming without proof that their speedometers weren’t working.
It states that every self-propelled motor vehicle when operated on the highway shall be equipped with a speedometer which shall be maintained in good working order.
Any person violating this section shall have committed an infraction and may be ordered to pay a penalty of no more than $25. No drivers license points, insurance points, or premium surcharge shall be assessed or imputed to any party on account of violation of this section.
An investigation by the Charlotte Observer found that prosecutors use this regularly. This makes sense as traffic in Charlotte, NC, is a consistent nightmare. Police officers are frustrated by giving out tickets that are dropped as speeders return to the highway.
Reducing a speeding ticket to $25 sounds good, but avoiding higher insurance premiums is even better. However, you still have to pay court fees. The best thing to do is simply obey the speeding limit.
