Kellogg drops hammer on Ohio food truck for copying waffle brand
You don’t mess with the breakfast king aka Kellogg. It’s dropping the hammer on a food truck in Ohio for having a name that’s too similar to its waffle brand, Eggo. The company also wants to take all the profit gained from the name, “L’eggoMy Eggroll”.
Kellogg sues Ohio food truck for copying its waffle brand
First of all, it doesn’t sound like, “L’eggo My Eggroll,” even sells waffles. The Ohio food truck serves Hibachi and other Asian foods typically reserved for lunch and dinner.
However, Kellogg isn’t having it because it considers the name to be too similar to its waffle brand and logo. The phrase,“L’Eggo my Eggo”, started being used around 1970 in waffle commercials and it’s widely known.
Therefore, Kellogg is suing the business for infringing on its trademarks. Hungry drivers who pull over for a snack might associate the Asian fair with Kellogg.
According to Whio, Kellogg had several conversations with the business owners to remove infringing content. However, the owners ignored them and then asked Kellogg to purchase the entire business in exchange for a substantial monetary sum.
They’re pretty brave to go up against Kellogg, which is losing patience. It wants to stop the food truck from resembling the Eggo brand and demands payment for all gains, profits, and advantages derived from the violation.
Plus, the breakfast king requests that the business pay attorney’s fees. The food truck has 30 days to respond. I suppose food trucks need to be more careful when picking out their names.
There are probably other fun eggroll phrases to consider like, “This is how we eggroll,” or “ eggs-cellent rolls”.
