You’re supposed to scream for ice cream, not scream because of the ice cream truck driver! One ice cream man in Indianapolis is serving up jail time instead of sweet treats after admitting to murdering a Chevrolet Camaro driver.

A jury found 43-year-old Darius Butts guilty of murder in a case that stems back to 2022. He shot a man in the 9900 block of East 38th Street, near North Mitthefer Road. 

Police officers found 32-year-old Desmond Banks lying on the ground beside his Chevrolet Camaro. He was shot multiple times, and medics pronounced him dead at the scene. Our condolences go to his family and friends. 

Detectives used security footage to investigate the incident. Butts was spotted driving an ice cream truck in a gas station parking lot. He was attempting to go around the Chevy Camaro. 

According to WTHR, Butts hit the Camaro and exited his truck to assess the damage, and tried to leave the scene. Then Banks ran out to stop him from leaving. 

As Banks gestured for Butts to stop, Butts pulled out a gun. He shot Banks multiple times and drove away. The gun was later found in Butts’ truck. He admitted to committing the crime and shared that he was caught on camera. 

Marion County Prosecutor Ryan Mears, shared that the victim clearly wanted to have a constructive conversation about an accident that is common in day-to-day life. 

However, the defendant was frustrated by the accident he caused and chose to gun down the victim, tragically ending Mr. Bank’s life and destroying his own.
