A careless moment by a tow truck driver nearly turned tragic for a Hyundai driver. But because of a red tag, an open-and-shut insurance payout left viewers with questions.

In a recent viral video, Lil Loe (@nunitsjustaperson) reveals how a tow truck crashed into her moving vehicle and how this could’ve been avoided if they were paying attention.  

Her TikTok has generated over 5.6 million views as of this writing.

The Hyundai driver’s dashboard camera shows the accident when the two collided together. The Hyundai vehicle is driving down a two-lane road and nothing seems unusual. However, a tow truck is backing out into the busy road in the distance. 

The Hyundai driver precedes going forward as she may have assumed the tow truck will wait for all vehicles to pass before going into the road. 

Unfortunately, this isn’t the case. The tow truck continues to back into the road right as the Hyundai driver is about to pass. In a matter of moments, the Hyundai sees the tow truck back into the road and she smashes into the tow truck.

The tow truck driver failed to recognize the length of the back of the truck and how it was sticking out. Because of this, the Hyundai driver crashes the front right of her car into the tow truck and spins out. The damage included a busted windshield, front bumper damage, and missing headlight. 

The Hyundai driver luckily is able to get out of the car safely and this is where she confronts the tow truck driver. 

“You [expletive] up everything. Why weren’t you looking?!? Why weren’t you paying attention? You could’ve [expletive] somebody,” the Hyundai driver vents. 

The two tow workers chose to not respond.

Valid Crash Out

Luckily, for the Hyundai driver, she was able to walk away from the crash. Although, this certainly could’ve been another story.

Viewers chimed in the comment section to confirm that the Hyundai driver wasn’t exaggerating the situation.

“Valid crash out. Your life was in danger. People forget how quickly an accident can turn into something much more serious,” one TikTok commenter added. 

“I just saw the dash cam, what a mess that’s all his fault,” another added. 

“The tow truck driver lost their job unless they are an owner,” a third added. 

Overall, the majority of the viewers agreed this was absolutely the tow truck driver’s fault.

“Get that money honey I’m glad y’all are alright,” one added. 

Now, one little detail may interfere with the payout commenters speculated about. Viewers noticed that there is a red tag that may impact the insurance payout. 

“Her car failed inspection meaning that she wasn’t legally allowed to touch the wheel in the first place. If his insurance finds this out they’re going to deny paying her claim and if she takes it to court she’s going to automatically lose,” one shared. 

Other viewers countered this and believe she’ll still receive compensation. 

“100% the tow truck’s fault and insurance is not going to deny a claim because of an inspection sticker,” one said. 

“Lawyer up! It doesn’t matter that it’s an inexpensive car. Lawyers for things like this are there to help push back on the insurance companies that want to give you the absolute minimum. You deserve to be compensated properly,” another shared. 

Would The Tag Really Make a Difference?

Having a rejected inspection tag on your vehicle isn’t the best look. Especially when it comes time to file an insurance claim.

Many states require drivers to have an inspection test to determine if your vehicle is safe to be on the roads.

Common issues that make a car fail an inspection test are check engine lights, a faulty gas cap, broken headlights or taillights, a clogged air filter, broken speedometer, or a malfunctioning catalytic converter, Progressive reports. 

When the car fails the inspection, a sticker or red tag is placed on the vehicle. Typically there is a specific time frame to repair the issue depending on how severe it is. A broken headlight can be fixed that day while other issues including a check engine light issue may need an appointment with the mechanic. 

Generally speaking, no matter how small or big the issue is, it’s best to avoid the roads until the issue is solved. 

It’s unknown what issue the Hyundai driver had and why the vehicle failed the inspection. What we can assume is that the woman will be pursuing legal action against the tow truck driver. 

So How Does A Failed Inspection Impact An Insurance Payout?

According to RGSG Law, “An inspection failure does not usually impact your case, nor does it warrant additional liability on the other driver’s part.” 

Although this isn’t always fully true depending on the accident. If the vehicle had critical issues and evidence of not operating properly from the inspection report, it can be used as a reason for the accident taking place. 

The good news is for the Hyundai driver is that getting hit by another driver with a failed inspection shouldn’t impact the insurance claim.

“Failure to comply with inspection requirements hardly explains why a driver hits you. A failed inspection has little bearing on the driver’s actions or inactions that lead them to strike your vehicle. It’s even possible there’s no connection between the other driver’s failed inspection and why you were hit,” per RGSG Law. 

While this favors the Hyundai drivers position, it’s not 100% guaranteed. Having a failed inspection certainly throws a wrench into the equation as this can be used as evidence that the vehicle wasn’t operating properly. 

Luckily, for the Hyundai driver, she had the dashboard camera making it clear the tow truck driver back into the busy street. Interrupting the flow of traffic by backing into the street is illegal in most states

So, the Hyundai driver should be in a solid position to receive a payout despite having a failed inspection as this accident wasn’t her fault. 

As the woman told MotorBiscuit, “We are still waiting for the payout and I’m okay just going to physical therapy.”
