Douglass Horn, an experienced truck driver, was fired due to testing positive for THC. It’s the active ingredient found in marijuana and causes drivers to become impaired.
Now he’s suing the CBD company that sold him a hemp product that allegedly falsely was advertised as being THC-free.
Horn picked the CBD product while looking to treat chronic shoulder and back pain after a serious truck accident. The store he went to provided a product that claimed to be free of THC. That is what causes marijuana users to get high.
CBD is typically a legal hemp compound. It has taken off in recent years as a natural health solution that doesn’t cause psychoactive impairment.
Allegedly, the CBD product did have THC, because it showed up in a routine drug test that got the semi-truck operator fired. According to ABC News, the Supreme Court is on his side.
Horn sued Medical Marijuana Inc. of Vista, California, and sought triple damages under the Racketeer Influenced and Corrupt Organizations Act, known as RICO.
The company argued that he couldn’t sue for higher damages due to claiming a personal injury instead of harm to his business. However, the court allowed Horn’s claim to go forward as his firing was a business injury and he’s been financially ruined.
