On a Tuesday evening in late October, a police officer in Brunswick Hills Township, Ohio pulled over a man for speeding. During the traffic stop, the cop noticed the guy wasn’t acting, well, sober. The officer pulled the driver out of the car. The man failed his field sobriety tests. He refused a breathalyzer.

While some drivers might think that refusing a breathalyzer test will protect them in court, this isn’t always the case. Especially if you have a case of beer in the car, too. Oh…and a coffee mug full of beer certainly doesn’t help, either.

Police found both in the Brunswick Hills vehicle. The driver faces charges related to operating a motor vehicle impaired, open container, and refusing to submit to a breath test. Don’t forget to tack on his speeding ticket, either.

Refusing a breathalyzer test after you’re arrested for driving impaired can have serious consequences, Simmrin Law Group says. However, if you refuse one before you’re formally handcuffed and have no prior DUIs, it could be beneficial to your case. The celebrity refused any impairment testing beyond field sobriety exercises. In turn, a judge suspended his license in New York. Timberlake’s attorney announced the singer accepted a lesser charge. It’s possible his refusal to take a breathalyzer played a part in the court’s decision, although we can’t confirm this.

In any event, driving while hiding your beer in a coffee mug near a whole case of the stuff won’t ever help your DUI defense.
