In a devastating and completely preventable tragedy, a 22-year-old Baton Rouge mother has been arrested weeks after her 1-year-old son fell out of a moving pickup truck and was fatally struck by the vehicle. The horrifying incident, which took place in late February, is a stark reminder of why child safety restraints and rear door locks are absolutely non-negotiable.
The incident took place on February 20, 2026, at a Murphy USA gas station parking lot near the old Cortana Mall in Baton Rouge, Louisiana. According to local police reports, 22-year-old Elizabeth Aguilar was navigating a turn in her 2014 Dodge Ram pickup truck. At this point, the rear passenger door swung open, and her 1-year-old son, Nicholas Aguilar, tumbled out onto the concrete pavement.
Tragically, the child was then run over by the truck’s rear passenger-side tire. Emergency responders rushed the toddler to a local children’s hospital in critical condition, but he ultimately succumbed to his severe injuries.
Fatal Negligence Inside the Cab
While the initial event was horrific enough, the subsequent police investigation revealed exactly why the toddler was able to fall from the moving vehicle. According to the arrest warrant, neither of Aguilar’s children riding in the back of the Dodge Ram were properly restrained. Astonishingly, investigators noted that there were no child seats inside the pickup truck at all.
To make matters worse, the vehicle was equipped with standard rear child safety locks, a basic feature designed to prevent rear doors from being opened from the inside. Police confirmed that these locks were not engaged at the time of the incident.

Facing Serious Charges
On Tuesday, March 17, the Baton Rouge Police Department officially arrested Elizabeth Aguilar in connection with her son’s death. According to the paperwork filed by the police department, the mother is now facing multiple severe charges, including:
- Negligent Homicide: For the death resulting from her failure to secure the child.
- Failure to Use a Child-Passenger Restraint System: A direct violation of strict Louisiana state laws requiring rear-facing car seats for children under two years old.
- Lack of Insurance and Registration: Routine traffic violations discovered during the crash investigation.
While modern vehicles, especially large pickup trucks like the Dodge Ram, are packed with advanced safety technology, none of those features matter if the absolute basics are ignored.
