Uh oh, Ram Heavy Duty trucks are facing some legal trouble. A federal judge brought the gavel down and ruled in favor of the class-action lawsuit alleging that Ram and Cummins misrepresented diesel emissions with defeat devices.

Certain Ram Heavy Duty trucks are involved in a Class action lawsuit related to false emissions readings. Allegedly Ram and Cummins misrepresented their products with the use of defeat devices. 

The trucks involved in the lawsuit include 2013 – 2019 Ram 2500 and 3500 HD trucks with the Cummins turbo 6.7-liter diesel engine. It’s found in about 630,000 trucks. 

According to CarBuzz, 11 plaintiffs shared that the trucks had a misrepresented performance due to the use of defeat devices. They argue that they wouldn’t have purchased these trucks if they knew their true emissions levels. 

A diesel defeat device is an aftermarket component that can be added to an engine to alter its operation to pass emission standards. Sometimes they are installed by third parties after someone purchases a truck. 

The lawsuit alleges that Ram and Cummins knew about these diesel defeat devices before selling the heavy duty trucks. Reportedly, the defendants raised five arguments to dismiss the claims but none are persuasive.

But Cummins has already settled with the Department of Justice and Clean Air Act with a $1.675 billion penalty. It also issued a recall to correct things for Ram truck drivers at no cost to owners. 

Ram and Cummins might lose even more funds as the lawsuit continues to unfold despite already paying the second-largest environmental penalty ever in the separate class-action lawsuit with the DOJ.
