
The Chevy Cruze just got slapped with an emissions cheating lawsuit

Do you remember the Chevrolet Cruze? It was discontinued in 2018. However, some owners of the Chevy Cruze aren’t letting the car retire in peace. Instead they’re coming after it with a class action lawsuit related to cheating emissions.
The Chevy Cruze faces a lawsuit over alleged emissions cheating
The Chevy Cruze is due to appear in court as 10 owners claim their cars were cheating emissions standards. According to Car Scoops, the plaintiffs allege that diesel models were equipped with defeat devices.
They shared that 2014 – 2015 models were equipped with software that could disable or reduce emissions controls when they weren’t being tested for emissions. This is very similar to the Volkswagen dieselgate situation.
As a result, the Cruze models may have released higher levels of NOx than General Motors advertised. Plus, the levels may have been higher than what the Environmental Protection Agency (EPA) allows.
The levels of pollution would prevent the General Motors cars from earning a Certificate of Conformity, which is needed for approval to sell vehicles in the United States. As a result, the plaintiffs are arguing that the cars should have been recalled.
Five years ago, this case was dismissed due to lack of evidence. Plus, one of the former plaintiffs had their vehicles repaired. They argued that the diesel cheating could cause them to lose money on future repairs.
However, they believe certain fraud claims are not preempted by federal emissions regulations and the Clean Air Act. Overall, the case is nine years old, so the judge ruled that new litigation won’t be permitted.
